Terms of Service

Welcome to BulkWapp (bulkwapp.com). These Terms of Service ("Terms") govern your access to and use of our WhatsApp CRM and bulk broadcasting platform (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. By using BulkWapp you represent that the business information you provide is accurate and that you are authorised to bind the organisation you list during signup.

2. Your account

• You are responsible for safeguarding your password and any WhatsApp Business API access tokens you connect.
• You must notify us immediately at security@bulkwapp.com of any unauthorised access.
• One account per organisation. Sharing accounts across unrelated businesses is not permitted.

3. Acceptable use

You agree NOT to use BulkWapp to:

• Send unsolicited spam, scam, phishing, gambling or adult content via WhatsApp.
• Message recipients who have not opted in to receive communication from your business.
• Violate Meta's WhatsApp Business Policy, Commerce Policy, or any applicable law (including India's DPDP Act, GDPR, TCPA, CAN-SPAM, and TRAI regulations).
• Impersonate another business, person or government entity.
• Distribute malware, conduct security probes, or attempt to reverse-engineer the Service.
• Resell, sublicense, or proxy bulk-messaging capacity to third parties outside your organisation.

We may suspend or terminate accounts that violate this section without notice. Repeated violations may be reported to Meta, which can lead to your WhatsApp Business Account being banned.

4. Your content

You retain all rights to the property listings, images, contacts and message content you upload ("Your Content"). By using the Service you grant BulkWapp a limited, non-exclusive licence to host, process and transmit Your Content solely to provide the Service to you.

You are solely responsible for ensuring Your Content does not infringe any third-party rights and that you have the legal basis to message every contact in your database.

5. WhatsApp Business API

BulkWapp is an independent platform built on top of Meta's official WhatsApp Business Cloud API. We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. WhatsApp™ is a trademark of Meta Platforms, Inc.

Message delivery, template approval, phone-number quality ratings, and account verification are controlled by Meta. We cannot guarantee delivery rates or account status.

6. Fees and free tier

BulkWapp's core CRM is offered free of charge today. Meta charges its own per-conversation rates for messages sent via the Cloud API — those costs are billed by Meta directly to the WhatsApp Business Account you connect, not by us.

We reserve the right to introduce paid plans for advanced features in the future. You will be notified at least 30 days before any pricing change affects you.

7. Service availability

We strive for 99% uptime but the Service is provided "as is" without warranty of any kind. We may suspend the Service for maintenance, security incidents, or for accounts that breach these Terms.

8. Termination

You can stop using the Service or delete your account at any time — see our Data Deletion Instructions. We may terminate or suspend your account immediately, with or without notice, if you breach these Terms or for any conduct that we, in our sole discretion, consider harmful to other users or to Meta's ecosystem.

9. Limitation of liability

To the maximum extent permitted by law, BulkWapp shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed INR 10,000 (Ten Thousand Indian Rupees).

10. Indemnification

You agree to indemnify and hold harmless BulkWapp, its directors, employees and affiliates from any claims, damages, losses or expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or any third-party rights.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email to your registered address at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
